WHAT ARE COOKIES?

Profiling cookies allow the user to carry out real monitoring of browsing, collect data on tastes, habits, personal choices of users, in order to build even detailed profiles of consumers and, possibly, direct them for commercial or marketing purposes. They are referred to in Article 122 of the Privacy Code where it provides that “the storage of information in the terminal equipment of a contractor or user or access to information already stored shall be permitted only on condition that the contractor or user has given consent after being informed in the simplified manner” (Article 122(1) of the Code). The GDPR places a prohibition on profiling in Art. 22, explicitly stating some exceptions among which point (c) mentions the consent by the data subject after receiving the information referred to in Art. 13 of the GDPR. However, profiling cookies are distinguished in turn from a subjective point of view, that is, based on the parties involved, in consideration of whether they are used and installed directly by the operator/owner of the website (so-called “first-party” or “operator” cookies), or used and installed by a site other than the one being visited, which installs cookies through the former (so-called “third-party” cookies).
In any case, cookies can be either temporary cookies (or session cookies) that are automatically deleted when the browser is closed, or permanent cookies that are not deleted but remain until specially deleted or until the expiration date defined by the site itself.

Technical cookies necessary for navigation
These cookies are essential for proper functioning of the website. The use of these cookies (which are not stored persistently on the user’s device and are automatically deleted when the browser is closed) is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to enable the safe and efficient exploration of the site. This category of cookies cannot be deleted.

Profiling cookies in the narrow sense are used
www.clayver.it has installed the Facebook Pixel cookie that allows it to track conversions that occur on its Web site as a result of the advertisements it is running on Facebook. For example, in the case where you want to track memberships to a particular campaign advertised on Facebook, the cookie tells Facebook each time a user has joined a particular campaign on Clayver’s site. Facebook compares the conversion event with the group of people to whom the ad was shown or who clicked on it, in order to provide Clayver with information that helps it understand the return on investment for its advertising spend.
